Existing <br />hardcover in the 75-250’ zone is 8,011 s.f. or 44 5e. Applicants propose <br />to remove all landscape beds lined with plastic or fabric on the property, <br />resulting in 0-75’ hardcover of 12 s.f. or 0.2% where no hardcover is <br />allowed, and 5,777 s.f. or 31.7% in the 75-250’ zone where only 25% <br />hardcover is normally allowed. <br />B.Planning Commission fmds that the removal of landscape bed hardcover <br />is a significant reduction and brings the property closer to conformity with <br />the City codes. <br />C.The proposed addition meets the required side and lakeshore setbacks and <br />does not encroach past the average lakeshore setback. <br />D.Proposed lot coverage by structures will be 11.1%, significantly less than <br />the 15% structural coverage allowed by the zoning code. <br />E.An enclosed screen porch constructed over the existing deck without a <br />permit should be subject to an after-the-fact building permit and review of <br />the construction by the inspection department to ensure code compliance. <br />The City Council'has considered this application including the findings and <br />recommendations of the Planning Commission, reports by Cit>' staff, comments <br />by the applicants and the effect of the proposed variance on the health, safet>’ and <br />welfare of the community. <br />The City Council finds that the conditions existing on this propert>’ are peculiar <br />to it and do not apply generally to other propert>* in this zoning district; that <br />granting the variance would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring propert)'; would not merely <br />serv'e as a convenience to the applicants, but is necessary to alleviate a <br />demonstrable hardship or difficult>'; is necessary to preserve a substantial propert)' <br />risht of the applicants; and would be in keeping with the spirit and intent of the <br />Zoning Code and Comprehensive Plan of the Cit)'. <br />Page 2 of 6 • • <br />1
