M3-2869 <br />May 20 2003 / June 18,2003 <br />Pase2 <br />3.Section 10.55, Subd. 8: Grading, Filling & Excavating within 75*: No filling, grading, <br />dredging, excavation, hardcover, temporary or permanent structures, obstructions, septic <br />systems, well or other construction shall be allowed on any land within 75 feet of the <br />ordinary high water elevation of any lake shoreline, nor on land abutting, adjoining or <br />affecting said area. (Request: to permit grading, filling and excavating within 75’ of the <br />OHWL of French Lake where no grading, filling or excavating is permitted). <br />4.Section 10.56, Subd. 16 (J) (4b): Movement of more than 500 cubic yards: For <br />movement of more than 500 cubic yards of material anywhere within the Shoreland <br />Overlay District, conditional use permit approval by the City Council is required in <br />addition to the required land alteration permit. (Request: to allow movement of more than <br />500 cubic yards of material within the shoreland overlay district). <br />5.Section 10.20, Subd. 3 (M) and Section 10.28, Subd. 4 (A): Animals: Animals shall be a <br />permitted accessory use in the RR-1B district. A minimum of two acres of open pasture <br />must be available for a single horse and one additional acre must be available for each <br />additional horse. <br />6.Section 10.56, Subd. 16 (N) (1): Agricultural Use: When permitted in the underlying <br />zoning district, general cultivation, farming, grazing, nurseries, horticulture, truck <br />farming, and wild crop harvesting shall be allowed in the Shoreland Overlay District <br />except that no such activity shall occur within the shore setback zone. (Request: to permit <br />an agricultural use (grazing of horses) within 150’ of the OHWL of French Lake where <br />no agricultural use is permitted). <br />7.Section 10.03, Subd. 15 (G) (2 c): Lakeshore lot fences: Fences shall not be constructed <br />within the defined lakeshore yard of a lakeshore lot, i.e. shall not be located within 150 <br />feet for Natural Environment Lakes. (Request: to allow a fence within 150' of the OHWL <br />of French Lake where no fences are permitted). <br />PLANNING COMMISSION: <br />Planning Commission recommended by a 6 to 0 vote to: <br />Approve the variances and a conditional use permit to reconstruct an existing gravel pathway <br />through a wetland to access an island of land on his property with the following conditions: <br />1. Permit approval from Minnehaha Creek Watershed District is required prior to construction <br />on the property; <br />2. Review and approval from the City Engineer is required prior to construction on the <br />property; and <br />3. The property owner will have the ability to routinely maintain the pathway, as approved.
