W3-2896 <br />66S North Fcrndale Road <br />Page 2 of 4 <br />Background <br />During 2002 staff met with the applicant on a number of occasions to discuss the potential for a lot <br />line rearrangement between this property and his current homestead at 625 North Femdale. A <br />variety of factors including the size of both properties, the existence of a private road w ithin the <br />property not covered by existing easements, etc. resulted in applicant choosing to go ahead with <br />construction of a new residence to replace the old house at 665 North Femdale without rearranging <br />lot lines. How ever, his intent was/is to continue to have his son live in the old house at 665 for the <br />next 24 months while he is in college. <br />Orono ordinances do not allow a detached second dw elling unit to remain in place on the property <br />after construction of a new principle structure, except and unless a Guest House Conditional Use <br />Permit is approved by the City Council. Mr. Bastiaens acknowledges that the property does not <br />contain the full 4 acres required to meet the City ordinance standards for a Guest House Conditional <br />Use Permit, and he is aware that approval of such a CUP requiring a lot area variance is not <br />guaranteed; however, it is his hope that the temporary use proposed can be approved with the <br />appropriate legal tools established to assure the City that the use w ill cease at the end of such <br />temporary period. <br />Site Plan Considerations <br />The property is by definition a comer lot, and by definition the north lot line of the property is <br />considered as *he front lot line, and the east lot line abutting the right-of-way of Femdale Road North <br />is considered the side street lot line. The location of the existing old house on the property is <br />southeast of the new house, and meets all required accessory stmeture setbacks should it be <br />converted to a mere accessory building. <br />Applicant wishes to continue to use the existing driveway access to North Femdale Road during the <br />duration of the temporary CUP, although the new home accesses the private road informally know n <br />as “Lydiard Road” to the north of the property. For the 24-month period staff would not oppose this <br />plan. <br />Septic System <br />Thi existing septic system serving the old house is functional but non-compliant with the 3' <br />separation from seasonal saturation mie, and under City codes would normally have to be replaced <br />by the end of December 2010. However, the drainfield for the old system is minimal at best and is <br />close to the foundation of the new house. Having discussed this matter with Septic Systems <br />Inspector Matt Bolterman, it is staffs reconunendation that the old house sewer line be connected <br />to the new house septic system during the temporary continued use of the old house.
