the property in question, so neighboring views should not change with the pool addition. <br />Setbacks <br />The proposed pool is located more than 7S' from the OHWL and meets the required setbacks <br />from the side lot lines, OHWL and structure. <br />Hardcover: 75 ’-250 ’ <br />The proposed pool is located in the 75’-250 ’ hardcover zone where 10,757 s.f. (25%) hardcover <br />is permitted. In addition to the pool, the proposal shows decking and retaining walls, all of which <br />are included in the hardcover calculations. As proposed, there is 10,749 s.f. (24.98%) hardcover <br />in this setback zone, just under the maximum permitted. No hardcover variance is necessary. <br />Structural Coverage <br />The pool is not considered part of the structural coverage on the lot since there are no portions of <br />it greater than 6’ in height. <br />History: <br />In 1988, a conditional use permit for a permanent dock was granted (zoning file #1285; <br />resolution #2446). There have been no other land use applications on this property. <br />The deck on the lakeside of the home was constructed in 2002. The house has been in existence <br />since before the current zoning ordinance was adopted. <br />Hardship: <br />The applicants have included their statement of hardship in Exhibit A. The applicants should also <br />be asked for their testimony regarding this issue. <br />Issues for Consideration: <br />1. The existing house was constructed before the zoning ordinance was adopted and does <br />not encroach into tl,e average lakeshore setback; <br />2. Although hardcover in the 75’ to 250 ’ setback zone increases with this proposal, it does <br />not exceed the maximum permitted in the zone; <br />3. Structural coverage does not increase with this proposal; <br />4. The proposed pool meets all of the required setback criteria; <br />5. iTie existing vegetation on the property screens the pool from the neighboring homes; <br />6. The neighboring homes will not be negatively affected by the construction of the pool due <br />to their orientation on the properties; and <br />7.
