ORDINANCE NUMBER , SECOND SERIES <br />AN ORDINANCE AMENDING SECTION 5.30, <br />SOLICITORS AND TRANSIENT MERCHANTS, <br />OK THE ORONO MUNICIPAL CODE <br />The City Council of the City of Orono ordains: <br />SECTION 1. Ordinance Amended. Ordinance Section 5.30, is hereby amended by <br />deleting the existing language and substituting the following language in its place: <br />CHAPTER 5: PEDDLERS, SOLICITORS AND TRANSIENT MERCHANTS <br />Subd. 1. Definitions. Except as may otherwise be provided or clearly implied by <br />context, all terms shall be given their commonly accepted definitions. For the purpose of <br />this chapter, the following definitions shall apply unless the context clearly indicates or <br />requires a different meaning. <br />A. “Canvasser” means a person who goes from house-to-house, door- <br />to-door, business-to-business, street-to-street, or any other type of place-to-place, for the <br />purpose of obtaining or attempting to obtain orders for goods, wares, products, <br />merchandise, other personal property or services of which he or she may be carrying or <br />transporting samples, or that may be described in a catalog or by other means, and for <br />which delivery or performance shall occur at a later time. The absence of samples or <br />catalogs shall not remove a person from the scope of this provision if the actual purpose <br />of the person's activity is to obtain or attempt to obtain o^ers as discussed above. The <br />term shall mean the same as the term “solicitor.” <br />B.“Goods” means any tangible thing of value, but not including <br />money, things in action or intangible personal property other than merchandise <br />certificates or coupons. The term includes such chattels as are furnished or used at the <br />time of sale or subsequently in the modernization, rehabilitation, repair, alteration, <br />improvement or construction of real property so as to become a part of such property <br />whether or not severable from such property. The term also includes merchandise <br />certificates or coupons, issued by a retail seller, not redeemable in cash and to be used in <br />their face amount in lieu of cash, in exchange for goods or services sold by such seller. <br />C. “Hawker" means a person who goes from house-to-house, door-to- <br />door, business-to-business, street-to-street, or any other type of place-to-place, for the <br />purpose of offering for sale, displaying or exposing for sale, selling or attempting to sell, <br />and delivering immediately upon sale, the goods, wares n^Mlircts, merchandise or other <br />personal property that the person is carrying or otherwise transporting. The term hawker <br />shall mean the same as the “peddler.” <br />D. “Peddler” means a person who goes from house-to-house, door-to- <br />door, business-to-business, street-to-street, or any other type of place-to-place, for the <br />f!
