#02-2840 <br />May 9,2003 <br />Page 2 <br />The City Engineer in his site plan review memo of August 8,2002 regarding traffic concerns made <br />the following comment: <br />“Suggested access to the potential commercial areas on the SE and SW corners of the site is <br />noted on the site plan. Full movement access can be allowed along Kelley Parkway and right <br />in/right out access can be allowed along Highway 12 for the SE parcel and full movement <br />access, with Highway 12 improvements can be allowed for the SW parcel at the location shown <br />on the marked up site plan. A right in/right out access can be allowed along Willow for the SE <br />parcer. <br />The City long ago established that no direct access to Highway 12 is intended for the area north of <br />12 between Willow and Old Crystal Bay, even though such access might be technically feasible. It <br />is staffs recollection that direct access to Willow Drive fiom the SE outlot was also not intended, <br />despite the Engineer’s comment that it is feasible. The primary issue is stacking distance and impact <br />on traffic flow on Willow. <br />Staff would like direction from the Council regarding the language to incorporate into the <br />Agreement. The Developer indicates he has relied on the comments in the Engineer’s memo of <br />August 8,2002 and has expected to be allowed such access. <br />Other Minor Revisions Completed or Pending <br />- The wananty provisions for utilities and roads have been consistently established as 24 months in <br />all documents. <br />- PUD 4 Agreement Section D regarding installation of improvements will have text reorganized to <br />make more clear the distinction between and maintenance responsibilities for public and private <br />improvements. <br />Rezoning Ordinance <br />The attached Rezoning Ordinance formally rezones the site to PUD; the residential portion north of <br />Kelley Parkway will be rezoned to PUD/RPUD and the commercial outlots will remain as PUD/RR- <br />1B until they are replatted as Lots and rezoned for office use as guided in the 2000-2020 CMP. <br />The rezoning ordinance becomes effective upon execution of the PUD NO. 4 Agreement by the City <br />and Dahlstroro, and upon City filing of the final plat of Phase I of STONEBAY with Hennepin <br />County. <br />J
