A RESOLUTION APPROVING <br />RENEWAL OF A CONDITIONAL USE PERMIT <br />PER SECTION 10.20, SUBDIVISION 3 <br />FILE NO. #03-2882 <br />WHEREAS, the Orono Baseball Association in cooperation with the Orono <br />Soccer Association (hereinafter "the applicants") are in the process of leasing property from the <br />Orono School District (hereinafter “the owner") located at 1030 Old Crystal Bay Road North <br />for the purposes of constructing a third baseball field, with a secondary use as a youth soccer <br />field within the City of Orono (hereinafter "the City") the property is legally described as <br />follows: <br />See Exhibit A, (hereinafter "the property”); and <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Commission held a public hearing on April 21, 2003, at which times all persons desiring to <br />be heard concerning this application were given the opportunity to speak thereon; and <br />WHEREAS, the applicants have applied for renewal of a cor.diiiona! use permit <br />originally granted by the City Council on SeptembCT 10, 2001 as documented in Resolution No. <br />4689, per Municipal Zoning Code Section 10.20, Subdivision 3 to permit consuvetion of a <br />combined baseball field and youth soccer field on the northeast comer of the property. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. <br />2. <br />This ^plication was reviewed as Zoning File #03-2882. <br />The original CUP approval was granted per Resolution No. 4689 adopted <br />September 10, 2001. <br />2. <br />3. <br />The property is located in the RR-IB rural residential zoning district. <br />Schools and associated uses accessory to a school arc a conditional use in the <br />RR-IB zoning district. <br />Page 1 of 12
