< OHWI, there shall be no greater than 25% hardcover. (Request: To allow 1 ,1 2 1 s.f. (40.82%) <br />hardcover within the 0 to 75’ lakeshore setback zone where none is permitted; and 285 s.f. <br />(28.64%) hardcover within the 75’ to 250 ’ lakeshore setback zone where 248.75 <br />s.f (25%) is permitted). <br />PLANNING COMMISSION: <br />Planning Commission recommended by a 7 to 0 vote to; <br />Approval of the following variances for new construction on the lot: <br />1 . lot area of 3,741 s.f (0.09 acres) where 21 ,780 s.f (0.5 acres) is required; <br />2. a lot width of 50’ where 100 ’ is required; <br />3. setback of 53 ’ from the OH WL of Lake Minnetonka where 75’ is required; <br />4. rear yard setback of 5’ where 30' is required; <br />5. an encroachment of 8-1 1 ’ into the average lakeshore setback; <br />6. l,029s.f (37.47%) hardcover within the 0 to 75’ lakeshore setback zone where none is <br />permitted; and <br />7. 420s.f (42.21%) hardcover within the 75’ to 250 ’ lakeshore setback zone where 248.75 <br />s.f (25%) is permitted. <br />Approval is conditioned on the following: <br />1 . A building of no more than 30 ’ and 2 'A stories in height w ill be permitted to be <br />constricted on the lot; <br />2. Overhangs must not e.xceed 1 ‘/i’ encroachments into the setbacks; <br />3. A minimal sidewalk may be added from the front door to the driveway, not exceeding 2' <br />in width. The sidewalk will count as additional hardcover in the 0-75’ setback zone, <br />beyond the 1,029 s.f (37,47%) hardcover proposed; <br />4. The existing culvert must be located prior to discussions with City staff regarding <br />relocation. Prior to obtaining a building permit, a survey show ing the proposed relocation <br />of the culvert will be required. A drainage and utility easement w ill be required over the <br />relocated culvert as well. The costs of these improvements will be the financial <br />responsibility of the pr'-perty ow ner. If relocation of the culvert can not be accomplished <br />without revisions to me house footprint, those revisions may be subject to further review <br />by the Planning Commission and City Council; <br />5. Existing and proposed grading and d<‘ainagc ways should be shown on plans submitted <br />for a building permit; and <br />6. Erosion control measures must be installed, inspected and approved prior to any work on <br />the site. <br />STAFF RECO\L\lENDATION: <br />. 4^10 approve the enclosed resolution. <br />COUNCIL ACTION REQUESTED: <br />To adopt or amend the enclosed resolution.
