(0.09 acres) where 21,780 s.f. (0.5 acres) is required; <br />2. a lot width of 50’ where 100 ’ is required; <br />3. setback of 48’ from the OMWI, of Lake Minnetonka where 75 ’ is required; <br />4. rear yard setback of 10 ’ where 30’ is required; <br />5. an encroaciimcnt of 16 ’ into the average lakeshore setback; <br />6. 1,121 s.f. (40.82%) hardcover within the 0 to 75 ’ lakeshore setback zone where none is <br />permitted; and <br />7. 285 s.f. (28.64%) hardcover within the 75 ’ to 250’ lakeshore setback zone where 248.75 <br />s.f. (25%) is permitted. <br />Pertinent Code Sections: <br />1 . Section 10.25, Subd. 6 (A & B): Area, Height, Lot Width and Yard Requirements: T he <br />following mininuim requirements in the LR-IC zoning district shall be obscr\ed: lot area'/: <br />acre; lot width 100 ’;rearyard30’.No structure or building shall e.xceed 2 '/i stories or 30’ in <br />height. (Request: To allow lot area of 3,741 s.f. (0.09 acres) where 21,780 s.f. (0.5 acres) is <br />required; a lot width of 50' where 100 ’ is required; and rear yard setback of 10 ’ where 30’ is <br />required). <br />2. Section 10.22, Subd. 2 and Section 10.56. Subd. 16 (C)(1): Structure within 75 ’: Structures <br />shall be set back a minimum of 75 ’ from the OllWL (929.4 ’) of lakes classified as General <br />Development. (Request: To allow a setback of 48’ from the OHWL of Lake Minnetonka <br />where 75 ’ is required). <br />3. Section 10.22.
