A RESOLUTION GRANTING CERTAIN VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SEC TION 10.22, SUBDIVISION 2; SECTION 10.24, SUBDIVISION 5 (B); <br />SECTION 10.56, SUBDIVLSION 3 (2); SECTION 10.56, SUBDIVISION 3 (3); <br />SECTION 10.56, SUBDIVISION 16(C)(2); SECTION 10.56, SUBDIVISION 16(C)(3); <br />SECTION 10.56, SUBDIVISION 16 (J)(5)(h);SECTION 10.56, SUBDIVISION I6(L)(I); <br />AND.SECTION 10.56, SUBDIVISION 16 (L)(2) <br />AND DENYING CERTAIN VARIANCES TO MUNICIPAL ZONING CODE <br />SECTIONS SECTION 10.03, SUBDIVISION 14 (C); AND SECTION 10.24, <br />SUBDIVISION 5(B) <br />FILE NO. 03-2887 <br />WHEREAS, Minnetonka Custom Homes Incorporated (hereinafter "the applicants") <br />are the owners of the property located at 4753 North Shore Drive, within the City of Orono <br />(hereinafter "the City") and legally described as follows ’ <br />Lot 4, Block 6. BI’RGQUIST & WICKLUNDS PARK, Hennepin County, <br />Minnesota, and that part of l.ake Street as dedicated in BLRGQUlS’l & <br />WICKI.UNDS PARK, I lennepin County, which lies between the southerly extension <br />of the east and west lines of Lot 4, Block 6, said BLRQUlSf & WICKLUNDS <br />PARK (hereinafter "the property"); and <br />WHEREAS, the applicants have applied to the City for variances from Municipal Zoning <br />Code Section 10.03, Subdivision 14(C); Section 10.22, Subdivision 2; Section 10.24, SuNlivision 5 <br />(B); Section 10.56. Subdivision 3 (2); Section 10.56, Subdivision 3 (3); Section 10.56. Subdivision <br />16 (C)(2); Section 10.56. Subdivision 16 (C)(3); Section 10.56. Subdivision 16 (J)(5)(h); Section <br />10.56. Subdivision (L)( 1); and Section 10.56, Subdivision 16 (L)(2) to pennit construction of a new <br />residence on the property, with a lot area of 8,172 s.f. (0.19 acres) where 43.560 s.f. (I acre) is <br />required; lot width of 50 ’ where 140 ’ is required; rear yard (street) setback of 19.2 ’ where 30’ is <br />required; side yard setback of 7.6’ where 10 ’ is required; 480 s.f. (12.6%) hardco\ er within the 0 to <br />75’ lakeshore setback zone where none is permitted; 2,05 1 s.f (46.8%) hardcover within the 75’ to <br />250 ’ lakeshore setback zone where 1,095 .».f (25%) is permitted; 1,504 s.f of lot coverage by <br />structure where 1.500 s.f is permitted; 15’ setback from the top of the bluff where 30’ is required; 6 ’ <br />♦ /- encroachment into the bluff impact zone where none is permitted; and placing fill in a bluff <br />impact zone where no fill is permitted, in the LR-IB ;'.oning district; and <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Page 1 of6
