area, the total combined footprint areas of ail principal and accessory structures shall not <br />exceed 15% of the lot area. EXCEPTION: Regardless of lot area, ever>' developed lot shall <br />be allowed at least 1,500 s.f. of lot coverage by a principal residence and garage structures. <br />(Request; To permit 1,504 s.f. of lot coverage by structure where 1,500 s.f. is permitted). <br />5. Section 10.56, Subd. 3 (2 &3) and Section 10.56, Subd. 16 (C)(2 &3): Top of Bluff <br />Setback & Bluff Impact Zone: Structures must be set back 30' from the top of the bluff. <br />The bluff impact zone is defined as the bluff and land located within 20 ’ of the top of a blufT. <br />Structures and accessory facilities, except stairways, landings, and lock boxes, must not be <br />placed within bluff impact zones. (Request: To permit a structure 15’ from the top of the <br />bluff where 30’ is required; and an encroachment of 6 ’ +/- into the bluff impact zone where <br />none is permitted). <br />6. Section 10.56, Subd. 16 (J)(5)(h): Filling in blufrimpaclzonc.s; Fill or excavated material <br />must not be placed in bluff impact zones. (Request: placing till in a bluff impact zone where <br />no fill is permitted). <br />PLANNING COMMISSION: <br />Planning Commission recommended by a 7 to 0 vote to: <br />Approve the following variances to permit construction of a new residence on the property: <br />1. lot area of 0.19 acres (8,172 s.f.) where 43,560 s.f. (1 acre) is required; <br />2. lot width of 50’ where 140' is required; <br />3. rear yard (street) setback of 16.2 ’ where 30’ is required, finding that this will still allow for <br />parking of vehicles in front of the garage while allowing the applicant to meet side setbacks <br />and reduce the lot coverage to 1,500 s.f; <br />4. 354 s.f (9.34%) hardcover within the 0 to 75’ lakeshorc setback zone where none is <br />permitted; <br />5. 1,965 s.f (44.85%) hardcover within the 75’ to 250' lakeshore setback zone where 1,095 s.f <br />(25%) is permitted; <br />6. 14 ’ setback from the top of the blulT where 30’ is required; <br />7. 7 ’ +/- encroachment into the bluff impact zone w here none is permitted; and <br />8. placing fill in a bluff impact zone where no fill is pcmiitted. <br />The Planning Commission found no hardship that supports the requested side setback variance or <br />lot coverage variance and recommended denial of those variances. The applicants shall submit <br />for building permit approval a design that meets the 10' required setbacks and does not exceed <br />1,500 s.f of lot coverage. <br />Approval of the above-listed variances is conditioned on the following: <br />1. a permit must be obtained from Hennepin County to change the access to the property; <br />2. plans for building permit application shall include contours showing proposed grading <br />and How arrows indicating drainage ways and rain gutters and proposed discharge points; <br />3. heavy-duty silt fence with steel t-posts shall be installed south of the home and north of <br />the retaining wall. It is critical that erosion control be installed, inspected and approved <br />prior to work on the site; and <br />4. the existing decks located within the 0-75’ setback zone must be reduced to no more than <br />32 s.f landings prior to footing inspection on the property.
