Lot Coverage Bv Structure <br />The existing structures on the property include the house with lakeside deck and pool <br />maintenance shed, totaling 3,074 s.f. 04.6%). Since the deck is proposed to increase in area from <br />399 s.f. to 550 s.f., the structural coverage increases to 3,225 s.f. (15.3%) where no more than <br />3,157 s.f. (15%) is permitted. <br />Hardship: <br />The applicants have included their statement of hardship in Exhibit B. The applicants should also <br />be asked for their testimony regarding this issue. <br />Issues for Consideration: <br />1. The deck has existed in this location since 1972; <br />2. The proposed deck replacement and addition will not change the structural setback from <br />the OHWL of Lake Minnetonka or the average lakeshorc setback; <br />3. The additional deck A'ill increase lot coverage by structures by 151 s.f.; <br />4. The proposal will add 6.67 s.f. of hardcover within the 0-75’ setback zone and will not <br />increase hardcover in the 75’ to 250’ setback zone; <br />5. To reduce hardcover in both setback zones, 488 s.f. of driveway could be removed; <br />6. There exists 87.5 s.f. of driveway encroaching onto the neighboring property that should <br />be removed; <br />7. The deck would continue to provide a landing for three sliding glass doors located on the <br />lakeside of the house; <br />8. There is an existing door that opens from the lakeside of the garage to the concrete patio; <br />9. The neighbors’ views of the lake are not greatly affected by the location of the deck; and <br />10. Other issues raised by the Planning Commiss''^n. <br />Staff Recommendations: <br />The proposed deck expansion increases the amount of structural coverage on the property beyond <br />the 15% limit and increases hardcover in the 0-75’ setback zone, increasing the nonconfonnity. <br />Therefore, staff can not support the proposed addition (filling in the “u” area). <br />Staff can support the deck replacement as it exists today, without the expansion, if the fol ’owing <br />hardcover removals are completed prior to footing inspection: <br />1. 87.5 s.f. of driveway encroaching onto the neighboring property; and <br />2. 488 s.f of driveway, reducing hardcover to 404 s.f (4.6%) in the 0-75’ st.back /one <br />and to 6,150 s.f (49.8%) in the 75’-250’ setback zone. <br />M3-28S4 John anJChenl Fiebelkorn <br />4/23/2003 <br />Page 4 of 5
