In October, 2002, the property owners applied for a building permit (Permit #P05705) to repair <br />their existing lakeside deck. At the footing inspection, the Building Inspector determined that the <br />deck could not be repaired due to excessive rotting. The property owners were informed that a <br />new deck would require variance approval. <br />Discussion: <br />Setback from the OHWL of Lake Minnetonka <br />The existing deck is located 68.3’ from the OHWL of Lake Minnetonka and it is proposed to be <br />replaced in the same location. As it exists, the deck is “u-shaped” and the most lakeward <br />protrusions are 68.3’ from the OHWL. <br />Although the applicants are requesting to remodel the exisMPg deck to fill in the “u ” area with <br />deck, they do not propose to go any closer to the lake than what exists. Therefore, there is no <br />change proposed for the setback from the OHWL of Lake Minnetonka. <br />Hardcover <br />0-75' Setback Zone <br />There exists 8,709.75 s.f of area .vithin this setback zone. Of this area, 586 s.f (6.7%) is existing <br />hardcover where none is permitted. The existing hardcover consists of a portion of the deck, a <br />concrete patio, driveway and concrete steps. <br />The deck, located above a portion of the concrete patio, is attached to the house and supported by <br />posts, placed 4” outside the concrete patio, on the ground. 1 hcrefore, the additional deck <br />proposed to fill in the existing “u-uhape ” of the deck will add 4” of hardcover along 19.7’ of <br />width or 6.57 s.f.. Given this, the Iu»idcover within this setback zone will increase to 593 s.f. <br />(6.8%). <br />In the 1989 lot split application, a portion of the driveway (488 s.f), located from the north side <br />of the garage to the west lot line, was shown “to be removed” on the survey. Of this area, 189 s.f <br />is located within the 0-75’ setback zone If this area of the driveway was removed, the hardcover <br />would be reduced to 404 s.f. (4.6%). <br />75 '-250' Seihac.y. Zone <br />There exists 12,339.75 s.f of area within this setback zone. Of this area, 6,449 s.f (52 3%) is <br />existing hardcover where 3,085 s.f (25%) is permitted. There are no hardcover additions <br />propo.s,^d ir. this zone. <br />If the a ca of the driveway proposed to be reduced in the 1989 lot split was removed, the amount <br />of hardrov'*; »n thi* setuack zone would be reduced by 299 s.f to 6,150 s.f (49.8%). <br />Avc.ace Lakeshore Setback <br />The existing deck encroaches 22’ into the average lakeshore setback. The proposed deck is not <br />proposed to encroach any further into the setback.
