I <br />i <br />#02-2840 <br />April 25,2003 <br />Page 2 <br />The flnal plat is for Phase 1 of the Development, which in addition to the construction of Kelley <br />Parkway and the regional pond will include the easterly grouping of 2-story and rambler townliomcs. <br />Future separate Phases will be the Lofts; the westerly grouping of rambler and 2-story townhomes; <br />and the 4 ‘Villa’ rambler townhomes at the northeast comer of the site. Site grading and road/pond <br />construction is expected to begin in early summer. <br />Staff is currently reviewing the status of the reconveyance for the portions of Kelley Parkway and <br />the stormwater pond within MnDOT right-of-way. <br />The most recent draft of the Planned Unit Development No. 4 Agreement is attached. Staff and the <br />City Attorney are in discussions with applicants and their attorney regarding certain aspects of the <br />Agreement, and we hope to have remaining issues resolved within the next two weeks. <br />Once the Plat and Agreement are executed, the Council will be presented with an ordinance for the <br />formal rezoning of the site to PUD, the residential portion north of Kelley Parkway will be rezoned <br />to PUD/RPUD and the commercial outlets will remain as PUD/RR-IB until they are replatted as <br />Lots and rezoned for office use as guided in the 2000-2020 CMP. <br />STAFF RECOMMENDATION <br />A majority of the pending issues have been resolved. The Final Plat Approval Resolution as drafted <br />inch: les a number of conditions that must be met before the plat can be released for filing. Staff <br />recominerds adoption of the attached “Resolution Approving the Plat of Stoi.ebay*. subject to any <br />additional conditions Council feels are appropriate. Note that the rezoning will not be acted upon <br />at this time, and staff intends to place the final PUD No. 4 Agreement on your May 12 agenda for <br />final approval of that document. <br />COUNCIL ACTION REQUESTED <br />Adopt tlie Final Plat Approval Resolution. <br />S’
