4. Section 10.03, Subd. IS (A): Non-Encroachments: The following shall not be considered to be <br />encroachments on yard requirements: chimneys, flues, belt courses, leaders, sills, pilasters, lintels, <br />ornamental features, mechanical devices, cornices, eaves, gutters and the like, provided they do not <br />extend more than 1 '/z feet. (Request: To permit overhang encroachments in a substandard side <br />setback of 2.5* on the north and 1.5’ on the south). <br />PLANNING COMMISSION: <br />Planning Commission recommended by a 5 to 0 vote to: <br />To approve the application as presented, with the following conditions: <br />1) The proposed addition must not be closer than 30’ from the rear lot line, with side <br />setbacks of 8.4 ’on the north and 6.5’ on the south, accommodating the reduced landing <br />deck; <br />2) Overhangs on the proposed addition will not encroach more than 1.75’ into the side and <br />rear setbacks, reducing structural coverage on the property; <br />3) The proposed decorative wall must be made compliant, with building plans for the <br />revised wall to be submitted prior to City Council review; <br />4) Hardcover in the 0-75’ and 75’-250’ hardcover zones must be further reduced from the <br />proposed by eliminating portions of the existing brick patio on the lakeside of the home, <br />leaving no more than a 4 ’ wide walkway; <br />5) Building plans shall include rain gutter and down spout locations, directing water away <br />from adjacent properties; <br />6) Erosion control shall be installed, inspected and approved prior to work on the site; and <br />7) The proposed hardcover and structural removals must be complete before footing <br />inspections are approved. <br />STAFF RECOMMENDATION: <br />Staff concurs with the Planning Commission recommendation and recommends approval of the <br />enclosed resolution, which incorporates the revised survey showing the hardcover and structural <br />removals, 30’ setback from the rear lot line, and to keep the decorative wall. <br />COUNCIL ACTION REQUESTED: <br />To adopt or amend the enclosed resolution. <br />t
