A RESOLUTION GRANTING A VARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 9 (B) <br />AND SECTION 10.03, SUBDIVISION 9 (D) <br />FILE NO. 02-2864 <br />WHEREAS, Josephine Carpenter (hereinafter "the applicant")is the owner of the <br />property located at 480 Russell Avenue, within the City of Orono (hereinafter "the City") and legally <br />described as follows: <br />“Exhibit A” attached, Hennepin County, Minnesota, (hereinafter “the property"); and <br />WHEREAS, the applicant has applied to the City for a variance from Municipal <br />Zoning Code Section 10.03, Subdivision 9 (B) and Section 10.03, Subdivision 9 (D) to construct <br />a 239 s.f. detached garage closer to the front property line than the principal residence, in the RR- <br />1B zoning district; and <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Commission held a public hearing on March 17,2003, at which time all persons desiring to be heard <br />concerning this application were given the opportunity to speak thereon. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. 1 his application was reviewed as Zoning File #02-2864. <br />2. The property is located in the RR-1B Zoning District, where 2 acres is the minimum <br />required lot area. The property consists of approximately 1.821 acres. <br />3. The Orono Planning Commission reviewed this application on March 17, 2003 <br />and recommended approval by a vote of 5 to 0. <br />4. 1 he Planning Commission made the following findings of fact: <br />Page 1 of 5
