AGREEMENT AND CONTRACT FOR FIRE PROTECTION <br />THIS AGREEMENT AND CONTRACT made and entered into this day of <br />2003 by and oetween the Excelsior Fire District, a Joint Powers Organization <br />with Deephaven, Excelsior, Greenwood, Shorewood, Tonka Bay (hereinafter referred to as <br />Excelsior Fire District), the City of Orono, a municipal corporation of the County of Hennepin <br />and State of Minnesota and witnesseth: <br />WHEREAS, the Excelsior Fire District has the facilities and equipment and is willing <br />and able to provide fire protection service to the City of Orono, and <br />WHEREAS, the City of Orono does desire to have fire protection service furnished by <br />the Excelsior Fire District and is committed to constructing and equipping a Fire Station in the <br />Navarre area (hereinafter referred to as the Navarre Station). <br />NOW, THEREFORE, in consideration of the covenants herein contained the parties <br />hereto agree as follows: <br />1.Definitions <br />A. City Fire Service Area is the area within the City of Orono receiving fire <br />protection from the Excelsior Fire District. <br />Services to be Rendered <br />During the tcmi of this agreement the Excelsior Fire District shall furnish all the fire <br />fighting services, rescue/medical rescue serv ices, and related fire protection serv ices to <br />the City of Orono for the Total Fire Service Area. This area is outlined in red on the <br />attached map marked Exhibit A hereinafter referred to as “The Total Fire Service Area.” <br />All of said Total Fire Service Area is located within the corporate limits of the City of <br />Orono. <br />Services Include: <br />Fire Fighting and Suppression Services <br />Rescue and Medical Rescue Services similar to current (2003) protocol in the <br />service area. <br />Duty Officer Response protocol similar to the Excelsior Fire District <br />Management of Apparatus located at the Navarre Station. <br />Management and supervision of the physical operation of the Nav arre Station <br />Recruitment of personnel for the Navarre Station. <br />Training of New recruits to Minnesota Certified firefighter 1 before p 'bation. <br />Training of New recruits to Minnesota Certified Firefighter 11 within 2 years of <br />probation.
