Frederick Ptizak <br />Box 158 <br />Spring Park, MN 55384 <br />Mr. Paul Weinberger <br />City ofOrono <br />2750 Kelly Pkwy <br />Orono, K04 55356 <br />June 20.2002 <br />Re; Frankiin/Hessburg Development <br />Lots 21 — 29,31 -33 BOc I, Baldur Park <br />Dear Mr. Weinberger: <br />As a follow-up to our telephone conversation of June 6.1 would appreciate receiving a <br />complete copy of the City’s file on the proposed development of the above mentioned <br />lots, including staff notes and recommendations. <br />Also, please confirm that the foUowing requirements would apply; <br />1. ) Replatting would be classifi^ as a Class III subdivision due to the extension <br />® **®‘^*®*^” of public roadway and request for flexible zoning (I I 03 <br />subd. 2.66.C.2 through c.4.). <br />2. ) Minimum public right of way required is 50* (28’ pavement width) and <br />maximum cul de sac length is 1000’ (11.33 subd. 4.). Does Baldur Park Road <br />meet these requirements? <br />3. ) Flood plate (below elevation 931.5) and wetlands shall be dedicated as <br />conservation easements and not be utilized for computing the area requirements <br />for any lot (11.41 sub. 2 .E and 3.B.4). <br />4. ) Pursuant to Sec 11.62, prerequisite to approval of a final plat is the dedication <br />to the public of 8% of the land being platted, or equivalent cash contribution be <br />made by the developer (e.g. 8% of $1 million = $80,000). <br />Also, please confirm that Mr. Franklin has not provided a utility easement “free of <br />charge" as he promised eight months ago at the City CouncU meeting on October 22 <br />2001. <br />Thank you for your clarification of these matters <br />Sincerely, <br />Frederick N.
