2. Creation of two commercial outlots on the remaining 10 acres to be rezoned and <br />developed at a later date. <br />3. As part of the residential development, construction of Kelley Parkway as well as <br />construction of municipal sewer, water, and storm sewer systems to ser\e the <br />proposed development; and <br />WHEREAS, the applicants have submitted a Preliminary Plat and General <br />Development Plan for approval by the City Council; and <br />WHEREAS, the Orono Planning Commission on November 19,2002 pursuant to <br />public notification held a public hearing on the application for Preliminary Plat and General <br />Development Plan approval, at which time all persons wishing to comment on the project were <br />provided the opportunity to comment; and <br />W'HEREAS, on November 19,2002 the Orono Planning Commission voted 7-0 to <br />recommend approval of the General Development Plan, including the proposed rezoning to RPUD, <br />the various elements of the Plan, preliminary plat approval for the entire plat, and final plat approval <br />for the portion of the Plan designated as Phase 1, subject to a number of conditions; and <br />W'HEREAS, the City Council makes the following findings regarding the General <br />Development Plan: <br />1 The Developer has provided a Development Plan for the residential portion of the <br />development that substantially conforms to the Development Standards for Attached <br />and Multi-Family Dwelling Structures for the RPUD District per Zoning Code <br />Section 10.33, Subd. 5(G) and has demonstrated to the satisfaction of the City <br />Council that all RPUD standards have been met or will be met, and has demonstrated <br />where such standards arc not met, and has satisfied the City Council that non- <br />compliance w ith said standards is remedied in a manner acceptable to the Council. <br />The Developer has demonstrated to the satisfaction of the Council that the RPUD <br />standard ot 10% of the gross project area has been set aside for private recreational <br />uses. The Developer has agreed to install a Tot Lot as one of the private park & <br />recreation amenities of the development. <br />Page 2 of 17
