Further, <br />the guest house and principal residence will be separated by more than 60’, i.e. more than double <br />the required side setback. <br />Guest House Variance: <br />Guest houses must meet minimum principal building setbacks. The guest house does meet this <br />requirement. Also, Section 10.03, Subd. 9 (D) states that an accessory structure (guest house) <br />shall not be located nearer the front or street lot line than the principal building on that lot. The <br />proposed guest house is proposed to be the same distance to the front lot line as the principal <br />structure. Therefore a variance is NOT required. <br />However, a variance is required for a second oversized accessory structure. An “Oversized <br />Accessory Structure” is defined as an accessory structure of footprint area in excess of 1,000 <br />square feet. Only one oversized accessory structure is allowed on a property. The intent of this <br />is to reduce visual massing of buildings on a site. Section 10.03, Subd 9 (C)(2) states: <br />Lot Area <br />Max Individual <br />Accessory Structure <br />Footprint Areas on Property <br />Maximum Allowed Total <br />of All Accessory Structure <br />Footprint Areas on Property <br />9.01 acre or more 3,000 s.f 6,000 s.f <br />The proposed guest house is approximately 1 ,500 square feet and the existing bam is <br />approximately 2,000 square feet. The guest house and bam are both accessory structures, <br />however the intent of the guest house is to be a separate dwelling on the property for people to <br />reside.
