VI <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the findings noted above, tlie Orono City Council hereby <br />grants a conditional use permit per Municipal Zoning Code Section 10.20, Subdivision 3 (G) for a <br />guest house and a variance to Section 10.03, Subdivision 9 (C) (2) to permit more than one oversized <br />accessory building on the property, subject to the following conditions; <br />1.The guest house shall be used and occupied by persons who would otherwise use the <br />primary residence on the property, such as domestic help, guests and relatives. <br />2.The property owners shall file a restrictive covenant on the property agreeing the <br />guest house will not be used as a rental unit and will not be used for a home <br />occupation except to the extent that such use may be allowed by City code. Further, <br />the restrictive covenant shall alert current and future property owners that the <br />property does contain two oversized accessory structures and any future subdivision <br />of the property would require City review of the status of the oversized accessory <br />structures in terms of lot area requirements. <br />3.The guest house shall be constructed in accordance with the plans submitted by the <br />applicant on file with the City of Orono and shall be developed in accordance with <br />the site plan attached to this resolution as “Exhibit B". <br />4.Authorities granted by this resolution are permissive only and must be exercised by <br />application for a building permit within one year of the date of Council approval or <br />this conditional use permit will expire on that date (January 27,2004). <br />5.Violation of or non-compliance with any of the terms and conditions of this <br />resolution shall constitute a violation of the Zoning Code, shall automatically <br />terminate any authority granted herein, and shall be punishable as a misdemeanor. <br />6. The undersigned applicant has read, understood and hereby agrees to the terms of this <br />resolution and on behalf of himself, his heirs, successors and assigns, hereby agrees <br />to the recording of this resolution in the chain of title of the property. <br />Adopted by the Orono City Council on this 27th day of January, 2003. <br />Pstgc3of7
