4. The Planning Commission made the following findings of fact: <br />7. <br />A. The guest house will not exceed the “2 acre per dwelling unit" density for <br />properties in the RR-IB zoning district. <br />B. The guest house meets all required principal building setbacks. <br />C.A septic system was replaced that is designed to handle the wastewater for <br />both the principal residence and guest house. <br />D.The justification for allowing the second oversize accessory structure is that <br />detaching the garage would meet the letter of the code but would result in <br />greater visual impacts due to a less compact guesthouse/garage combination. <br />The City Council finds that granting a conditional use permit to allow a guest house <br />will not be detrimental to the health, safety or general welfare of the public, would <br />not adversely affect light, air nor pose a fire hazard or other danger to neighboring <br />properties, nor will its use depreciate surrounding property values and that the <br />proposed level of use of the property will be in keeping with the intent and objectives <br />of the Zoning Code and Comprehensive Plan of the City. <br />The City Council finds that the conditions existing on this property are peculiar to it <br />and do not apply generally to other property in this zoning district; that granting the <br />variances would not adversely affect tralTic conditions, light, air nor pose a fire <br />hazard or other danger to neighboring property; would not merely serve iis a <br />convenience to the applicant, but is necessar> to alleviate a demonstrable hardship or <br />difficulty; is necessary to pre.serve a substantial property right of the applicant; and <br />would be in keeping with the spirit and intent of the Zoning Code and <br />Comprehensive Plan of the City. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments by <br />the applicant and the elTcct of the proposed variance on the health, safety and welfare <br />of the community. <br />Page 2 of 7
