Conililiooal use permit review. <br />(a) Plainung comnn.ssion. council .Applications for conditional use pcirmts <br />shall be reviewed by the planning commission and the coi neiJ in the same manner as <br />other zoning conditional use permit applications. No conditional use pennit shall be <br />issued unless the applicant, m support of hts application, shall submit certified <br />engineering data, sur\ cys, site plans, flowagc calculations and other information as the <br />city may require in order to determine the effects of such development on the affected <br />land and water areas. <br />(b) \otu c to state. Upon filing of an application for a conditional use pennit, <br />the zoning administrator shall submit to the commissioner of natural resources a copy of <br />the application for proposed conditional uses sufficiently in advance so that the <br />commissioner will receive at least ten da> s' notice of the hearing. A copy of all decisions <br />granting conditional penmts shall be forvsardcd to the commissioner of natural <br />resources w ithin tc:' days of such action <br />(c) Condmons of appro\al In granting a conditional use penmt, the city ma> <br />prescribe appropriate conditions and safeguards, which arc in confonnity with the <br />purposes of this article. Violations of such conditions and safeguards, when made a part <br />of the temis under wliich the conditional use pemiit is granted, shall be deemed a <br />violation of this aniclc punishable as provided in this chapter. <br />(d) Enginccni.g review The city engineer or other designated evpcrt shall <br />review applications for conditional use pennits and applications for uses within the <br />general lloodplain district and. con.sistciU with Minnesota Regulations NRS6-S7. shall <br />dcicnninc whether the proposed use is in the floodwav or flood fnnee and shall <br />dclcnmnc the regulatory flood protceiion elevation. The dcsienatcJ engineer or expert <br />shall: <br />(1) Hstimute the peak discliuigc of the regional flood. <br />(2) Cvlciilaie the w alcr surface profile of the regional flood based upon a <br />hydraulic anaivsis of tlie stream channel and overbank areas <br />(3) Compute the floodwav necessary to convey the regional flood without <br />increasing flood stages more than 0.5 foot An equal degree of <br />cncroacitmcnl on both sides of the stream within the reach w ill be <br />assumed <br />(c) Factors upon which the decision of the city shall he based In passing <br />upon conditional u.sc applications, the city shall consider all relevant factors specified in <br />other prov isions of this article, and <br />(I) The danger to life and property due lo increased flood heiglits or velocities <br />caused by encro,.chmcnis.
