Declaration of nuisance. <br />Any filling, alteration, constmetion or artificial obstruction of the floodplain and <br />\scilands conservation area is declared to be and to constitute a public nuisance unless a <br />pcnv.it to construct and maintain the obstruction has been obtained in the manner <br />provided in this subdivision <br />(Code 19S4. § 10 55(17)) <br />See. 78*1167. Required. <br />A use pennit issued by the zoning administrator in confomiity \* ith the provisions <br />of this article shall be secured pnor to the: <br />(1) Erection, addition or alteration of any building or structure; <br />(2) Use or ch.mge of use of a building, structure or land; <br />(3) Change or extension of a nonconfomr.ng use, and <br />(4) Placcmciu of fill or excavation of materials within the floodplain. <br />Where required by this article or any other zoning provisions, such use permit may <br />require prior review and approval by the plamung commission and the council. <br />(Code 1984. § 10 55(19)) <br />See. 78-1168. Certificalc of zoning compliance. <br />It is unlaw ful to use. occupy or permit the use or occupancy of any building or <br />premises, or both, created, erected, changed, converted, or wholly or partly altered or <br />enlarged in its use or structure until a certificate of zoning compliance shall have been <br />issued by the zoning administrator stating that the use of the building or land confomts to <br />the requirements of this article. Where a nonconfonmng use or structure is extended or <br />substantially altered, the certificate of zoning compliance shall specifically state the <br />manner in which the nonconforming structure or use differs from the provisions of this <br />article <br />(Coile 1984. § 10.55(22))
