AGREEMENT FOR SNOW STORAGE <br />1354 REST POINT CIRCLE <br />THIS AGREEMENT, made this day of 2004, between Dennis S. <br />Walsh and Amanda L. Hcien, Husband and Wife (“Owner”) and City of Orono, a Mimicsota <br />municipal corporation (“O/ o/io”). <br />A. <br />B. <br />RECITALS <br />Owner is the property owner for the subject property located at 1354 Rest Point Circle in <br />the City of Orono Hennepin County, Minnesota. <br />Orono desires to obtain an agreement for the use of an existing gravel area, adjacent to <br />the west side of the street, located on the subject property (the “Agreement Area”), as <br />shown on Exhibit A, for the putposes hereafter set forth, and the Owner has agreed to <br />approve such agreement upon the temis and conditions herein. <br />AGREEMENT <br />1.Owner hereby grants to Orono the right for temporary use of the Agreement Area <br />for the puiposes of snow storage necessary for the efficient City plowing of Rest <br />Point Circle. <br />2.Orono hereby agrees to pave the Agreement Area to minimize the amount of <br />crushed rock material that is currently deposited from the Agreement Area on the <br />owner’s lawn from snow storage operations. <br />3.This agreement .shall inure to the benefit of and be binding upon the heirs, legal <br />representatives, successors and assigns of the Owner. The agreement contained <br />herein shall be deemed to nm with, burden and benefit of the subject property <br />4.This agreement shall tenninate ten (10) years from the date signed below. Both <br />parties shall then renew tliis agreement, write a new agreement, or terminate this <br />agreement. <br />Page 1 of 2
