Box 66 <br />Crystal Bay, MN 55323 <br />(952) 249-4600 <br />ZONING FILE; #04-3067 <br />NOTICE OF COUNCIL ACTION <br />DATE OF NOTICE: November 23, 2004 <br />TO: Lecy Construction <br />15012 Highway 7 <br />Minnetonka, MN 55345 <br />COPIES:Dennis & Amanda Walsh <br />1354 Rest Point Circle <br />Mound, MN 55364 <br />TYPE OF APPLICATION:Hardcover Variance <br />DATE OF MEETING: November 22,2004 <br />Motion: To approve per tlic findings and conditions of the resolution previously mailed <br />to you, except that Exhibit A of the resolution has been revised to reflect allowing the <br />gravel at the north end of the property to remain due to the City’s snow storage needs. <br />The revised Exhibit A is attached for your reference. <br />VOTE: 5 FOR 0 AGAINST <br />After the applicant left the meeting, the following actions occurred: <br />Motion: To reconsider the approval motion noted above. <br />VOTE: 5 FOR 0 AGAINST <br />Motion: To table the application and pursue acquisition of an casement to permit snow <br />storage indefinitely over the gravel area noted on the survey attached to this notice. <br />VOTE; 5 FOR 0 AGAINST <br />The City will follow this notice up with a proposed easement for your consideration. This <br />easement agreement would be formally heard at the December 13, 2004 City Council <br />meeting. The purpose of the easement agreement is to ensure snow storage ability at this <br />location indefinitely. Should you not agree to the granting of the easement the City <br />Council M'ill reconsider its approval of retention of the gravel area. <br />A building permit for the proposed addition may be obtained prior to the December 13, <br />2004 City Council meeting, however the applicant is hereby notified that should an <br />easement for snow storage not be granted the City Council may rescind their approval of <br />retention of the gravel area noted on the revised survey attached to this notice. A public <br />hearing would be held and a formal notice would be mailed to the applicant in order to <br />rescind approval of the gravel area. <br />If you desire certified copies of the official Council minutes, they are available front the <br />City Clerk after review and approval by the City Council. <br />■K. .. , <br />% <br />ih <br />----------------------------------------------'■
