Hard cover limitations. <br />(a) No hard cover or impervious surface shall be placed, located or <br />constructed within 75 feet of the ordinary high water level of any lake or <br />tributary, except for stairways, lifts, landings and lockboxes as regulated <br />elsewhere in this Code. <br />(b) Between 75 feet and 250 feet of the OHWL, there shall be no greater than <br />25 percent hard cover. Between 250 feet and 500 feet of the OHWL there <br />shall be no greater than 30 percent hardcover. At that time, hardcover was required to be removed in order to <br />meet the 25% allowance within the 75’-250’ zone. It is unclear whether all the hardcover <br />that was required to be removed, was in fact removed. <br />Then, in early 1999 the same prior owners filed for an after-the-fact hardcover variance <br />to permit approval of an already constructed lakeside deck. That variance was approved <br />and the findings can be found in Resolution #4272, attached as Exhibit K.
