The lot is 50 ’ <br />by 135 ’ and there is no location that would be conforming with regard to the principal <br />structure. The proposed 20 ’ x 30 ’ garage will meet principal stnicturc setbacks and will <br />not be located nearer to the street than adjacent homes. Additionally, the garage and <br />alterations to walkways and driveway as proposed will be 0.4% over the allowed 35% <br />hardcover allowance for this property. <br />The applicant shares a driveway that is partly on the adjacent property to the west. Tlicre <br />is a cross-easement for this shared driveway, although the shared portion extends outside <br />the easement. <br />Hard.ship Statement <br />Applicant has completed the Hardship Documentation Form attached as Exhibit B, and <br />should be asked for additional testimony regarding the application. <br />Hardship Analysis <br />/m considering appiications for variance, the Planning Commission shall consider the effect of the <br />proposed variance upon the health, safety and welfare of the community, existing and anticipated traffic <br />conditions, light and air, danger of fire, risk to the public safety, and the effect on values of property in <br />the surrounding area. The Planning Commission shall consider recommending approval for variances <br />from the literal provisions of the Zoning Code In instances where their strict enforcement would cause <br />undue hardship because of circumstances unique to the Individual property under consideration, and <br />shall recommend approval only when It Is demonstrated that such actions will be in keeping with the <br />spirit and intent of the Orono Zoning Code. <br />If the Planning Commission feels that the setback location of the existing home and the <br />size of the lot are hardships there may be justification for granting a variance in this <br />situation. <br />Issues for Consideration <br />1. This garage will substantially remove the applicants’ house from view from the street. <br />All you will see from the street is the garage. While there are other 600 s.f. garages <br />in the neighborhood, they are normally to the side or the rear of the house. Will this <br />garage, as oriented, be out of character with the neighborhood? <br />2. Would a 600 s.f. garage with the narrow end facing the street be more acceptable? <br />3.
