The provisions of this <br />aiticle, including the designation of floodplain <br />and wetlands conservation areas, shall be in <br />addition to all other provisions of this chapter. <br />Whenever conflicts occur between other provi­ <br />sions of this chapter and provisions of this article, <br />the most restrictive provision shall prevail. <br />(Code 19S4, § 10.55(6)) <br />Sec. 78-1111. Regulatory flood protection el­ <br />evation. <br />The regulatory flood protection elevation shall <br />be dn elevation no lower than one foot above the <br />elevation of the regional flood plus any increases <br />in flood elevation caused by encioachinents on the <br />floodplain. <br />(1) The regulatory flood protection elevation <br />within the floodway and flood fringe dis ­ <br />tricts shall be established by adding 1.0 <br />foot to the base flood water surf-’ce eleva­ <br />tions within floodway listed in the flcodway <br />data table contained in the flood insur­ <br />ance study. Regulatory flood protection <br />elevations between cross sections shall be <br />interpolated. <br />(2) The regulatory flood protection elevation <br />for Lake Minnetonka shall be 932.5 MSL. <br />(3) The regulatory flood protection elevation <br />within the general floodplain district shall <br />be calculated by a qualified registered <br />professional engineer in accordance with <br />procedures set forth in this article. <br />(Code 1934, § 10.55(7)) <br />Sec. 78-1112. Development restricted; prohi ­ <br />bition. <br />Except as specifically permitted, no filling, <br />grading, dredging, excavation, hard cover, tempo­ <br />rary or permanent structures, obstructions, septic <br />systems, well or other construction shall be al­ <br />lowed within the floodplain and wetlands conser­ <br />vation area; nor on any lands within 26 feet of <br />such area; nor on any land within 75 feet of the <br />ordinary highwater elevation of any lake shore ­ <br />line, nor on land abutting, adjoining or affecting <br />the area if such activity upon those adjacent areas <br />is incompatible with the policies expressed in. this <br />article and the preservation of those consei-vation <br />areas in their natural state. <br />(Code 1984, § 10.55(8)) <br />Sec. 7S-1113. Floodway district (FW). <br />The following uses have a low flood damage <br />potential and do not obstruct flood flows. These <br />uses shall be permitted within the floodway dis ­ <br />trict to the extent that they are not prohibited by <br />any other provision this Code and provided all <br />permits or authorizations are received as may be <br />required by other provisions of this Code or reg­ <br />ulation of other governmental agencies having <br />jurisdiction, including without limitation, the Min­ <br />nesota Department of Natural Resources, the <br />Minnehaha Creek Watershed District, and the <br />Lake Minnetonka Conservation District. In addi ­ <br />tion, no use shall adversely affect the capacity of <br />the channels or floodways or any tributary to the <br />main stream or of any drainage ditch, or any <br />other drainage facility or system; and no use shall <br />adversely affect the quality or quantity of ground- <br />water runoff or the quality of the natural environ­ <br />ment. <br />Permitted uses, when in conformance with <br />this chapter, are: <br />a.Agricultural uses, such as pasture, <br />grazing and wild crop harvesting. <br />b. Fish and wildlife sanctuaries. <br />c. <br />d. <br />e. <br />f. <br />g <br />Recreational uses, such as fishing <br />accesses, unpaved hiking, biking, <br />horseback or nature trails, and pic­ <br />nic areas. <br />Residential uses, such as lawns and <br />gardens, provided no filling, gradmg <br />or hard cover is involved. <br />Seasonally installed residential boat <br />docks for single-family dwellings. <br />Natural stone riprap shoreline pro­ <br />tection. <br />Sand beach blankets meeting the <br />requirements of the department of <br />natural resources regulation <br />6MCAR15021B. <br />CD78:172
