A RESOLUTION DENYING A <br />VARIANCE PER MUNICIPAL ZONING CODE <br />SECTION 78-350 (B) <br />FILE #04-3044 <br />WHEREAS, ihc City of Orono is n municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, pursuant to State Statutes 412 et. seq. and 462 ct. scq., the City <br />Council of the City of Orono has adopted zoning regulation for the protection of the <br />public health, safety and general welfare; and <br />WHEREAS, Jennifer A. Simon (hereinafter “the applicant ”) is the owner of the <br />property located at 3925 Cherry Avenue within the City of Orono (hereinafter “the City ”) <br />and legally described as follows: <br />Lots 1 & 2, & in Lot 21, HICKORY HILL, Hennepin County , Minnesota <br />(hereinafter “the property ”); and <br />WHEREAS, the applicant has applied to the City of Orono for a variance to <br />permit construction of an addition, requesting the following approvals; <br />1.Section 78-350 (b); To allow a rear yard setback of 20 feet when 30 feet <br />is nonnally required. <br />WHEREAS, the City Council has reviewed the application; the recommendation <br />of the City staff and Planning Commission; and the comments and written statements <br />submitted by the applicant. <br />NOW, THEREFORE, HE IT RESOLVED that the City Council of Orono. <br />Minnesota hereby denies the requested variance as described above based on one or more <br />of the following findings of fact concerning this property: <br />1, Tlie property consists of 0.39 acres, or 17,195 s.f. in land aa’a. <br />2. The Zoning Ordinance specifically states in Section 78-1 that the front lot <br />line on a corner lot “shall be the shortest dimension on a public or private <br />Page I of3
