The lot is approximately 0.6 acres with only 37.5 feet of <br />width at the shoreline and 107.5 feet of width at the 75 foot setback. Therefore, the lot is <br />non-conforming in area and width an.d requires approval of these variances in order to <br />rebuild. The Zoning Ordinance allows for administrative approval when the lot meets <br />80% of the zoning district requirements, however this lot is only 62% of the area <br />requirement and 48% of the width requirement at the shoreline and 77% of the <br />requirement at the 75 foot setback. <br />Hardship Statement <br />Applicant has provided a Hardship Documentation Form as Exhibit B, and should be <br />asked for additional testimony regarding the application. <br />Hardship Annivsis <br />In considering applications for variance, the Planning Commission shall consider the effect of the <br />proposed variance up, n the health, safety and welfare of the community, existing and anticipated <br />traffic conditions, light and air, danger offtre, risk to the public safety, and the effect on values of <br />property in the surrounding area. The Planning Commission shall consider recommending approval <br />for variances from the literal provisions of the Zoning Code in Instances where their strict <br />enforcement would cause undue hardship because of circumstances unique to the individual <br />property under consideration, and shall recommend approval only when it Is demonstrated that such <br />actions will be In keeping with the spirit and intent of the Orono Zoning Code.
