MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, July 26, 2004 <br />7:00 o ’clock p.m. <br />(8. 804-3036 DURABIL T ASSOC/A TES, INC. ON BEHALF OF JAMES BROOKS, <br />3785 WATERTOWN ROAD - VARIANCE, Continued) <br />Gundlach stated that the existing side yard setback variance allows a structure within 14.4' of th' <br />side yard which staff would be opposed to increasing. <br />Moorse reminded the Council that a 50’ setback is normally required ard that this request would be <br />going beyond the original allowance for hardship and increasing the nonconformancy . <br />McMillan pointed out that the whole property provides little buildable area, while adequate <br />turnaround room to provide safe access to Watertown Road at this blind intersection is justified. <br />Sansevere asked whether staff could support a compromise of a 12’ side yard setback to allow a <br />22’ garage. <br />Gundlach reiterated staff s position that the garage remain at 20'. <br />Fritzler stated that he would have found that to be an acceptable alternative. <br />Murphy stated that allowing the applicant a 20’X24’ garage is not a hardship, since he will still <br />have the same amount of square footage. <br />Mayor Peterson moved, Murphy seconded, to approve the existing i4.4’ setback as originaiiy <br />approved. <br />McMillan asked if the motion could be amended to allow the 12’ setback. Mayor Peterson denied <br />the request. <br />VOTE: Ayes, Mayor Peterson and Murphy; Nays, McMillan, White, and Sansevere. <br />White moved, McMillan seconded, to grant a 12’ eastern side yard setback in order to <br />construct a two stall garage at the property located at 3785 Watertown Road. VOTE: Ayes, <br />McMillan, White, Sansevere; Nays Mayor Peterson and Murphy. <br />MAYOR/CITY COUNCIL REPORT <br />Sansevere requested that an upcoming work session include a discussion regardmg the new <br />smoking bans, and at the request of a resident, ways to more aggressively pursue illegal docking of <br />boats in Orono. <br />*9. PROCLAMATION - NATINAL NIGHT OUT - RESOLUTION NO. 5209 <br />Murphy moved. White seconded, to adopt RESOLUTION NO. 5209, a Resolution <br />proclaiming August 3,2004 as ’’National Night Out” in Orono. VOTE: Ayes 5, Nays 0. <br />PAGE 8 of 10 <br />H
