A RESOLUTION GRANTING <br />SUBDIVISION OF A LOT LINE REARRANGEMENT <br />FOR PROPERTIES <br />LOCATED AT 900,925, & 965 LONG LAKE ROAD <br />FILE NO. 04-3038 <br />WHEREAS, the City of Orono is a municipal corporation organized and existing <br />under the laws of tlie State of Mimtesota; and <br />WHEREAS, the City Council of Orono (hereinafter “City Council”) has adopted <br />subdivision regulations for the orderly, economic, and safe development of land within <br />the City; and <br />WHEREAS, the City Council has considered the application for a subdivision of <br />a lot line rearrangement by Darrell E. Anderson and Karin H. Anderson, husband and <br />wife and Bruce B. Dayton, a single person (hereinafter the “applicants”) for properties <br />legally described as: <br />Attached as Exhibit A (hereinafter “the properties”); and <br />WHEREAS, the properties consist of 3 developed parcels owned by the <br />applicants an shown on the survey attached hereto as Exhibit “A”; and <br />WHEREAS, after due published and mailed notice in accordance with Minnesota <br />Statutes 462.358 et. seq. and the City of Orono’s Zoning and Subdivision Codes, the <br />Orono Planning Commission held a public hearing on July 19, 2004, at which time all <br />persons desiring to be heard concerning this application were given the opportunity to <br />speak thereon; and <br />WHEREAS, the applicants have completed all requirements for the City for a <br />metes and bounds subdivision of a lot line rearrangement for division and combination <br />purposes, resulting in the relocation of the common lot boundaries between the <br />properties, as shown in the survey attached as Exhibit “A” resulting in new legal <br />descriptions for each as shown in Exhibit “A”; and <br />WHEREAS, at their regular meeting held on August 9, 2004, the Orono City <br />Council considered the subdivision of a lot line rearrangement application of the <br />applicants noting the following findings of fact: <br />Page 1 of 4
