. t <br />f <br />4.Commercial site plan approval and conditions for proposed retail/office buildings <br />on Lots 1 and 2. <br />WHEREAS, on May 14, 2004 the Metropolitan Council via letter indicated that <br />the Comprehensive Plan amendment is in conformance with metropolitan system plans, <br />consistent with the Regional Development Framework, and has no impact on the plans of other <br />units of local government, and that the City may put the amendment into effect; and <br />WHEREAS, on June 14, 2004 the City Council adopted Resolution No. <br />formally adopting the Comprehensive Plan Amendment; and <br />WHEREAS, the Applicants have agreed to execute Planned Unit Development <br />No. 4A Agreement providing for the installation of certain improvements as a condition of site <br />plan approval for the construction of commercial retail buildings and ancillary improvements on <br />the Property, and which agreement documents the general and detailed conditions for use and <br />development of the Property; and <br />WHEREAS, the Applicants have agreed to submit and execute the appropriate <br />shared access, parking and maintenance agreements over the portions of driveways, parking <br />areas and other shared improvements and facilities within and Lots 1 and 2; and <br />WHEREAS, the Applicants have agreed to grant public casements to the City <br />over the proposed trails to be constructed by the developer within the Property; and <br />WHEREAS, the Deve!on*»r completed or has agreed to complete all other <br />requirements of the Zoning Code, platting ordinances and related Ordinances of the City <br />including; <br />1. <br />2. <br />3. <br />Completion of all platting requirements of Preliminary Plat Resolution No. <br />Dedication on the plai of Drainage and Utility Easements. <br />Submittal of Minnehaha Creek Watershed District (MCWD) permit approving the <br />grading and stormwater management facilities plan for the development of the <br />Property as proposed per the Grading, Drainage and Erosion Control Plan, Sheet <br />dated <br />4.Payment to the City of Stormwater and Drainage Trunk Fees for the development <br />of the Property in the amount of SS23,94S.OO as established in General Concept <br />Plan Approval Resolution No.____.
