f 78.417 ORONO CITY CODE <br />9.The applicant shall demonstrate <br />by providing a coverage/inter­ <br />ference analysis and capacity <br />analysis prepared by a regis- <br />tered professional engineer that <br />the location of the antennas as <br />proposed is necessary to meet <br />the frequency spacing needs of <br />the personal wireless service <br />system and to provide ade­ <br />quate portable personal wire­ <br />less service coverage and capac­ <br />ity to the area. <br />(Code 1984, 10.20(2). 10.28(2); Ord. Conditional uses. <br />Within any RR-IB one-family rural residential <br />district, no structure or land shall be used for the <br />following uses without a conditional use permit: <br />Public schools and pairochial or private <br />schools which teach a curriculum similar <br />to a public school, provided no building <br />shall be located within 50 feet of any lot <br />line of an abutting lot in an R district and <br />a fence is erected 15 feet or more from all <br />street lot lines where the abutting use is <br />for open play, and nursery schools provid­ <br />ing 50 square feet of playground space per <br />pupil. <br />(2) Uses accessory to a high school. The fol­ <br />lowing uses are accessory to a high school <br />use and require a separate conditional <br />use permit: <br />Indoor ice arenas. All such facilities and <br />structures shall be located on the same <br />tax parcel as the principal high school use <br />to which they axe accessory. No such struc­ <br />tures shall be located less thain 50 feet <br />from any lot line of an abutting lot in an R <br />district. Such facilities shall not be sepa­ <br />rated from the principal high school use <br />by a public road. All such facilities shall <br />be owned and operated by the school <br />district, or by a nonprofit organization, <br />under a land lease arrangement with the <br />school district. The developer of such a <br />facility, prior to final conditional use per­ <br />mit approval by the city council, shall <br />demonstrate financial capability to com­ <br />plete construction of the facility, by pro­ <br />viding suitable documentation that at least <br />SO percent of the estimated project costs <br />are in the control of the school district or <br />nonprofit lessee. <br />(3) Churches, including those related struc­ <br />tures located on the same site which are <br />an integral part of the church proper, and <br />convents or homes for persons related to a <br />religious function on the same site, pro­ <br />vided no building other than a residence <br />shall be located within 50 feet of any lo; <br />line of an abutting lot in an R district. <br />(4) Golf courses, country clubs, tennis clubs, <br />public swimming pools serving more than <br />one family, scout camps. YMCA camps, <br />YWCA camps, church camps, or private <br />nonprofit parks, playgrounds and other <br />similar uses. The principal structure fer <br />any of these uses shedl be 100 feet or more <br />from any abutting lot in an R district, and <br />accessory structures shall be a minimum <br />of 50 feet from any lot line. <br />Public service structures, including but <br />not limited to electric transmission lines, <br />buildings, such as telephone exchange sta­ <br />tions, booster or pressure regulating sta­ <br />tions, wells, and plumbing stations, ele­ <br />vated tanks, lift stations and electrical <br />power substations, provided no building <br />shall be located within 50 feet from any <br />lot line of an abutting lot in sn R district. <br />Prior to gTEinting such permit it shall be <br />found that the architectural design cf <br />service structures is compatible to the <br />neighborhood in which it is tc be located <br />and thus will promote the general wel­ <br />fare. Public service structures that have <br />been approved by the city at required <br />public hearings for public improvements <br />projects shall not require a conditional <br />use permit, but such structures shall be <br />subject to all other appropriate standards <br />set forth in this section; amendments to <br />approved plans involving design and/'or <br />Supp. No. 1 CD78:70
