A/'/ <br />ZONING REGUIAnONS i 78-609 <br />DIVISION 10. PRD PLANNED RESIDENTIAL <br />DISTRICT <br />Sec. 78*601. Purpose. <br />This plan is available to land subdividers sub­ <br />ject to council approval, as alternative to stan­ <br />dard nuniruuA lot size subdivision of land. The <br />purpose of this plan is to enhance the appearance <br />of neighborhoods through preservation of natural <br />open spaces, to counteract the effects of urban <br />congestion and monotony, to provide cohesive <br />structure to neighborhood design, to offer recre­ <br />ation opportunities close to home, and to aid in <br />improving the welfare in general of city residents. <br />(Code 1984, § 10.32(1)) <br />Sec. 76-602. Submission of plan'.. <br />Landowners may submit land subdivision plans <br />for any R district without adherence to minimum <br />lot size requirements for each building lot, pro­ <br />vided that the total number of building lots or <br />dwelling units shall not exceed the number of <br />such lots or units permissible under the minimum <br />lot size requirements of the zoning district or <br />districts in which such land is situated. <br />(Code 1984, § 10.32(2)) <br />Sec. 78-603. Council discretion. <br />Dwelling units permitted may be, at the discre­ <br />tion of the council and subject to the conditions <br />set forth by the coimcil, in detached, attached or <br />multiple-family dwelling structures, subject to <br />the limitations provided for in each zoning dis­ <br />trict. <br />(Code 1984, § 10 32(3)) <br />Sec. 78-604. Open space. <br />The dedication, ownership, use and mainte­ <br />nance of open spaces created by the application of <br />a planned residential development shall be sub­ <br />ject to conditions deemed necessary by the council <br />to assure the preservation of such open spaces for <br />their intended purposes. <br />(Code 1984, 5 10.32(4)) <br />Sec. 78-605. Dedication of open space. <br />The dedication and ownership of the open <br />spaces referred to in section 78-604 may be through; <br />(1) Homeowners' association; <br />Landlord maintenance; <br />Special service district; <br />Municipal ownership; or <br />Any other method deemed appropriate by <br />the council to accomplish the purposes of <br />this plan. <br />(Code 1984, § 10.32(5)) <br />(2) <br />(3) <br />(4) <br />(5) <br />Sec. 78-606. Site plan. <br />The proposed site plan, including location, spac­ <br />ing and basic design of proposed buildings, street <br />and parking plans, water and sewer (public or <br />private) plans, and plans of open space available <br />for park or recreational purposes shall be submit­ <br />ted for approval by the planning commission and <br />the council. <br />(Code 1934, § 10.32(6)) <br />See. 78-607. Hearings. <br />The council may direct that a public hearing be <br />held to review plans governed by this division. <br />(Code 1984, § 10.32(7)) <br />Sec. 78-608. Final approval. <br />Final approval of plans governed by this divi­ <br />sion shall not be granted until all conditions set <br />by the council are met, and, further, the council <br />shall not approve any such planned residential <br />development prior to the legally binding estab­ <br />lishment of the open space dedication, ownership <br />and maintenance provisions, such provisions to <br />be guaranteed by bonding or other means s.itis- <br />factory to Uie council. <br />(Code 1984, § 10 32(8)) <br />Sec. 78-609. Subdivision requirements. <br />All provisions of subdivision procedure estab­ <br />lished by chapter 82, except as modiHed in this <br />division, shall govern applications under this plan. <br />(Code 1984, § 10.32(9)) <br />CD78:109 <br />\
