Hardcover variance to permit 30% hardcover in the 75’-250’ zone when 25% is <br />normally allowed and 33% currently e.Kists. <br />2. Conditional use permit to allow plumbing in an accessory building. <br />Staff Recommendation: Staff recommends approval of the plans incorporating the <br />following stipulation: <br />1. The applicant agrees to the filing of the covenant regarding the conditional use <br />permit for plumbing in an accessory building (as noted within this report). <br />Pertinent Zoning Ordinance Sections <br />Sec. 78-282. Lakeshore hard cover and huid alteration regulations. In any LR-IA, LR- <br />IB, LR-IC or LR-lC-l district, within 75 feet of shoreline, there shall be no excavating, <br />filling, hard cover, temporary or permanent structures except as permitted under section <br />78-281. Within 75 to 250 feet of the shoreline, there shall be no greater than 25 percent <br />hard cover. Within 250 feet to 500 feet of the shoreline, there shall be no greater than 30 <br />percent hard cover. Witltin 500 feet to 1,000 feet of the shoreline, there shall be no <br />greater than 35 percent hard cover. <br />(Code 1984, § 10.22(2)) <br />Sec. 78-1288. Hard cover limitations. <br />(a) No hard cover or impervious surface shall be placed, located or constructed <br />witliin 75 feet of the ordinary high water level of any lake or tributary, except for <br />stairways, lifts, landings and lockboxes as regulated elsewhere in this Code. <br />(b) Between 75 feet and 250 feet of the OHWL, there shall be no greater than 25
