ORDINANCE NO. 7,3RD SERIES <br />INIHRIM ORDINANCE PURSUANT TO MINNESOTA STATUTES SECTION <br />462.355, SUI3DIVISION 4. TO ESTABLISH A MORATORIUM PROHIBITING THE <br />GRANTING OF PRELIMINARY SUBDIVISION APPROVAL. ZONING <br />(CUP/VARIANCE) Al’PROVAL, REZONING. OR PUD APPROVAL WITHIN HIE <br />MORATORIUM AREA AS DEFINED HEREIN. <br />1 HE CITY OF ORONO ORDAINS: <br />The Municipal Code of ihc City of Orono is amended by adding Ordinance No. 7, 3rd <br />Series. <br />SECTION 1. SM«ncnL.oX.JiQlici[, The City Council finds that the City i.s <br />presently faced with the potential of applications for .subdivision, re/oning, zoning <br />(CUP/Variance), or PUD approvals for property within the Moratorium Area as defined <br />in .Section 2. <br />It appears to the Council that the consequences of allowing such applications to be <br />appiovcd may be uiulcsirable because the cuneni ordinances may not be consistent with <br />the City’s zoning and development goals. I he Council, Iheicfoie, finds th.it it is necessaiy <br />to study the impact of development under current oidinanccs to dctemiine whether they <br />lullill the underlying purjmses of the City's land use and zoning provisions. <br />I he Council further Inuls th.it if, as a result of this study, the land use controls and zoning <br />provisions contained in the City code need to be revised, such revision is a process th.u <br />cannot be accomplished until a .study has been completed and a hearing held. Since enactment of an <br />amendment to the code would undoubtedly modify c.xistmg reguLitions conceniing <br />permitted laiul use .iiul zoning perloiinancc standards, the granting of preliminary ’ <br />approval of subdivision applications, zoning (CUlWariance) applications, rezoning <br />applications, or PUD for pioperty within; tlie Mor.itornim Area would be contrary to the <br />punmsc of the zoning enabling act, Minne.sota .Statutes Section 462.351. et seq. The <br />Council further finds that it would be unwise, improper and uii|ust to .allow individual <br />development to occur during this study. <br />SECTION 2. MorsltorhilU.Ar-€4 As used in the Ordinance.
