GalTion
Title: Planning Ditectot
Administrator Approval:Agenda Section:
Zoning
Item Description: Interim Ordinance - Moratorium - Revised Language
List of Exhibits
A - Moratorium Ordinance as Adopted 4-12-04
B - Revisions Option I (Revises the Moratorium Area)
C - Revisions Option 2 - (Same as Option 1 plus eliminates moratorium on CUP.'VAR approvals)
D - Option 2 in Adoption Format
The Interim Ordinance adopted Apiil 12 eslablislicd a moratorium area that included areas cf
the City having “allowed densities of 2 residential dwelling units per acre or greater". This
language inadvertently included all of Orono ’s '/j-acre zoning districts (Navarre area,
primarily) which was not intended by slafT. The language prohibits the granting of
preliminary subdivision approval, zoning (cup/variance) approval, rezoning, or PUD
approval.
Exhibit B (Revisions Option I) would change llie above language by redefining the
Moratorium Area as all property in Orono "which is currently guided in the Orono 2000-
2020 Community Management Plan to allow residential densities in excess of two dwelling
units per acre" except for Stonebay. This language functionally eliminates the R-IB, I.R-IC,
and LR-lC-1 !4 acre districts from the moratorium.
Exhibit C (Revisions Option 2) goes one step further ’"n refining the impacts of the
moratorium, by also changing the language to now allow CUP and variance approvals during
the moratorium, while still prohibiting approvals of preliminary subdivisions, rezonings, and
PUD'S. This change will allow existing developed properties within the Moratorium area to
gain approvals for CUP’s and variances, since it is not the intent of the moratorium to hinder
improvements of existing developed properties.
Staff Recommendation
Staff recommends adoption of Option No. 2 per the ordinance attached as Exhibit D.
COUNCIL ACTION REQUESTED
Motion to approve the revised language per Option 2 and adopt Ordinance No. 8, 3'** Series,
anieiiding Ordinance No. 7, 3''^ Series, the Interim Ordinance adopted April 1 2, 2004.
