e t A < i( <br />A RRSOl.UTION AUTHORIZING THE PERMANENT TAKINC; OE LAND <br />BY EMINENT DOMAIN FOR DRAINA(;E AND UTIUI lES <br />WHEREAS, the City Council has determined that it is necessary and in the public <br />interest that the City acquire by eminent domain a pennanent drainage and utilities easement for <br />public purp<^ses at the location hereinafter speeified. <br />WHEREAS, the City Council has ordered preparation of a resolution authorizing the <br />taking of such casement by eminent domain, and authorizing the City Attorney to commence <br />condemnation proceedings. <br />1HEREKORE, BE IT RESOLVED, by the City Cou . il of Orono: <br />I.That it is hereby determined that the taking of a permanent drainage and utilities <br />casement for public purposes over the parcel of land set forth in paragraph 4 <br />hereof is necessary and in the public interest, in addition to the ingress and egress <br />casement previously authorized and as a part of those eminent domain <br />proceedings. <br />I hat the City shall acquire by eminent domain a permanent drainage and utilities <br />easement for public pur|ioses over the parcel of land set forth in paragraph 4 <br />hereof, and that the C'ity Attorney is hereby authorized and directed to commence <br />condemnation prt)ceedings, includim; a motion for “quick-take ” transfer of title <br />and posse.ssion in the District Court of Hennepin ('ounty and for appointment of <br />(’onunissioners to iletennine the damages, if any, stislained by those persons with <br />interests in the property as a result of such taking. <br />That the City Attorney is hereby further authorized to acquire such pennanent <br />ca.sement through settlement with those persons with interests in the property, if <br />such permanent easement can be acquired through settlement in conjunction with <br />obtaining the easement provided for in Cits of Orono, Kesolution of the City <br />('ouncil No. 5(W7. <br />4.
