r <br />RESOLUTION AUTHORIZING THE PERMANENT TAKING OF LAND <br />BY EMINENT DOMAIN FOR DRAINAGE AND UTILITIES <br />WHEREAS, the City Council has detennined that it is necessary and in the public <br />interest that the City acquire by eminent domain a permanent drainage and utilities casement for <br />public purposes at the location hcrcinaner specified. <br />WHEREAS, the City Council has ordered preparation of a resolution authorizing the <br />taking of such easement by eminei.' domain, and authorizing the City Attorney to commence <br />condemnation proceedings. <br />THEREFORE, BE IT RESOLVED, by the City Council of Orono: <br />1. That it is hereby detennined that the taking of a pennanent drainage and utilities <br />casement for public purposes over the parcel of land set forth in paragraph 4 <br />hereof is neces.sary and in the public interest. <br />2. That the City shall acquire by eminent domain a pennanent drainage and utilities <br />casement for public purposes over the parcel of land set forth in paragraph 4 <br />hereof, and that the City Attorney is hereby authorized and directed to commence <br />condemnation proceedings, including a motion for “quick-take” transfer of tide <br />and possession in the District Court of Hennepin County and for appointment of <br />Commissioners to determine the damages, if any, sustained by those persons with <br />interests in the property as a result of such taking. <br />3. That the City Attorney is hereby further authorized to acquire such permanent <br />casement through settlemen.t with those persons with interests in the property, if <br />such permanent easement can be acquired through settlement in conjunction with <br />obtaining the easement provided for in City of Orono, Rc.solution of the City <br />Council No. 5097. <br />4.
