IV* s <br />File M4-2977 <br />Jsinuary 20, 2004 <br />Page9ofll <br />area has been functionally a “no-man’s land” and overflow parking for many years, and <br />its formalization as a parking facility should trigger establishment of landscaped space <br />that, at least, approaches City Code Standards. <br />Lighting <br />Tlie applicant has provided a written description of the proposed lighting (Exhibit D). <br />Tlte lighting for the current lower parking lot seems adequate, although it may need some <br />repair, which the applicant has proposed to do. Staff would not recommend any further <br />lighting in this area as the lot abuts residcntially zoned property. <br />The applicant has also proposed lighting under tlie proposed awning in an effort to <br />illuminate the sidewalk. Staff finds no issues regarding these lights, however, the bulbs <br />must not be exposed and the illumination shall not overlap onto the residential property to <br />the south. <br />Building Quality and Materials <br />Attached Exloibit G1 & G2 show the exterior appearances of the proposed entrances and <br />Exhibits Ol, 02, & 03 shows the current exterior facade. The applicant has not <br />indicated tlie e.xterior materials proposed for these entrances. City Code Section 78-645 <br />requires that the exterior building materials must be face brick, natural stone, specially <br />designed pre-cast concrete units, factory fabricated and finished metal framed panel <br />construction, or other materials as may be approved by the Council. Combinations of <br />such materials shall be pennitted. The Planning Commission should discuss what <br />materials are appropriate for the proposed entrances. Staff would recommend that the <br />color scheme and materials match the existing fa9ade and that the roof of the entrances be <br />shingled. <br />Bus Shelter Re-Location <br />The City’s Public Services Director has requested that a 100 s.f easement be granted to <br />the city to allow the current bus shelter near D’vinci’s restaurant to be relocated to the <br />northeast corner of the applicants site. A 10’ x 10’ easement in tlie northeast corner of <br />the site is proposed in Exhibit Pl-9. The City Council has authorized re-iocation of the <br />shelter. The Plamiing Commission should determine whether lliis should be included <br />with approval of the commercial site plan review, and how this will impact tlie <br />applicant’s signage or parking plan. <br />Conditional Use Permit <br />City Code Section 78-644 requires a conditional use permit for any B-1 district to operate <br />a Class I or Class II restaurant. The notable distinction between a Class I and Class II <br />restaurant, in this case, is the ability to serve liquor. The proposed restaurant will serve <br />liquor and is therefore considered a Class II restaurant. <br />The Zoning Ordineuicc doesn ’t specifically outline conditions which the proposed <br />restaurant must meet, other than items which protect the health, safety and general <br />welfare of the surrounding community. There was one neighborhood inquiry into what <br />was being proposed, but no negative comments regsurling the restaurant. Staff would <br />d
