A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />.SECTIONS 78-350(B); 78-282; AND 78-1288 <br />- FILE NO. 03-2928 <br />WHEREAS, Michael Mischke, a single person, (hereinafter "the applicant") is owner of <br />the property located at 1972 ShadywoodRoad within the City ofOrono (hereinafter the "City") and legally <br />described as follows: <br />^ . <br />Lot 37, "Shadywood", Hennepin County, Minnesota <br />(hereinafter the "property"); and <br />WHEREAS, the applicant has made application to the City of Orono for variances to <br />Orono Municipal Zoning Code Sections 78-3S0(B); 78-282; and 78-1288 to allow construction of a <br />detached garage and a first floor level deck on a lot ofO. 16 acres in area and SO* width where 0.5 acre*: <br />in area and 100' width is required; to allow a building encroachment of the side yard and street yard, as <br />well as building encroachment within the 75' lakeshore yard where no structure is normally allowed; and <br />to allow hardcover in excess of the 0% hardcover normally allowed in the 0-75' lakeshore zone and in <br />excess of the 25% hardcover normally allowed in the 75-250' lakeshore zone. <br />NOW, THERE FORE BE IT RESOLVED bythe City Council of Orono, Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #03-2928. <br />2. The property is located in the LR-IC Lakeshore Residential Zoning District, which <br />requires minimum lot area of 0.5 acres (21,780 s.f.) and minimum lot width of 100'. <br />The lot area is 0.16 acres (6,915 s.f) and defmed lot width is 50'. <br />3. The Planning Commission reviewed this application at a public hearing held on March 15, <br />2004 and on a vote of 5-2 recommended conditional tqiproval of the applicant’s “Plan A” <br />based on the following findings and recommended conditions; <br />a.A house has existed on the property for many years, and the prop«ty is served <br />by m micipal sewer and water. <br />Page I of5
