WHEREAS, on June 12,2000, the City Council of the City of Orono (the “City ”) <br />adopted Resolution No. 4479 granting preliminary approval for platting of a section of public road <br />easement located at 4575 Wayzata Boulevard approval; and <br />WHEREAS, Resolution No. 4479 required that Richard Rudd and Shane Rudd (the <br />“Applicants”) submit the final plat for approval no later than December 31,2003; and <br />WHEREAS, the Minnesota Department of Transportation (“MnDOT*) has delayed <br />construction of an access road which will serve the Rudd’s property; and <br />WHEREAS, the Applicants requested and were granted an extension of the effective <br />period of preliminary plat approval to December 31,2004; and <br />WHEREAS, the Applicants have requested an additional extension of the effective <br />period of preliminary plat approval to July 31,2006 as a result of MnDOT ’s further postponement of <br />the road project. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of <br />Orono, Miimesota, as follows: <br />1 . The effective period of preliminary plat approval is hereby extended to July 31, <br />2006; and <br />2. All other terms and conditions of Resolution #4479 are hereby reaffirmed. <br />Adopted by the City Council of the City of Orono, Minnesota at a regular meeting held on the <br />22nd day of March, 2004. <br />ATTEST: <br />Linda S.
