It is unlawful for any person to build, alter or repair any <br />seawall, retaining wall or otherwise change the grade or shore of lakeshore property <br />without a conditional use permit issued by the Council. <br />Sec. 78-1250. Conditional uses. <br />Conditional uses allowable within shoreland areas shall be subject to the review and <br />approval procedures and criteria and conditions for review of conditional uses established <br />in this chapter. The following additional evaluation criteria and conditions apply within <br />the shoreland overlay district: <br />1. Evaluation criteria. A thorough evaluation of the water body and the topographic, <br />vegetation and soils conditions on the site must be made to ensure: <br />a) The prevention of soil erosion or the possible pollution of public waters, both <br />during and after construction; <br />b) The visibility of structures and other fscilities as viewed from public waters is <br />limited; <br />c) The site is adequate for water supply and on-site sewage treatment; and <br />d) The types, uses and numbers of watercraft that the project will generate are <br />compatible in relation to the suitability of public waters to safely accommodate <br />these watercraft. <br />Sec. 78-1282. Steirways, lifts and landings. <br />Stairways nnd lifts are the preferred alternative to miyor topographic alterations for <br />achieving access tq> and down blufGi and steep slopes to shore areas. <br />Sec. 78-1286. Topographic alterationa/grading and filling. <br />(b.) Grading, filling or excavating of more than ten cubic yards is prohibited within 75 <br />feet of the ordinary high v^ter level of the public waters enumerated in section 78-1217. <br />Grading, filling or excavating of ten cubic yards or less shall require city staff review and <br />permit and be subject to other pertinent sections of this chapter. <br />Sec. 78-1288. Hard cover limitations. <br />a) No hard cover or impervious surface shall be placed, located or constructed <br />within 75 feet of the ordinary high water level of any lake or tributary, except for <br />stairways, lifts, landings and lockboxes as regulated elsewhere in this Code. <br />b) Between 75 feet and 250 feet of die OHWL, there shall be no greater than 25 <br />percent hard cover. Between 250 feet aitd 500 feet of the OHWL there shall be no <br />greater than 30 percent hardcover. Between 500 feet and 1,000 feet of the OHWL <br />there shall be no greater than 35 pe*^:ent hardcover. <br />List of Exhibits <br />A. Application <br />B.
