If ^e wall were moved to meet a S foot setback no planning <br />actions would be required, however, the applicant feels the extra foot is needed to accommodate the <br />side entry. <br />Staff RccomueDdatioD <br />Deny the request consistent with City Building Inspector Bruce Vang’s comments attached as <br />Exhibit B, to allow a 4 foot setback for a retaining wall when 5 feet is normally required. <br />COUNCIL ACTION REQUESTED <br />The City Council has two options: <br />1.Deny the conditional use permit request to allow a retaining wall within 5 feet of th^ <br />property boundary as the plans can be revised to eliminate approval of the conditional use <br />permit, and direct staff to draft a denial resolution; or, <br />2.Approve the conditional use permit to allow a .'etaining wall within 5 feet of the property <br />boundary and direct staff to draft a resolution for approval at the next regularly scheduled <br />City Council meeting.
