The approved landscaping plan attached to this Agreement as <br />Sheet LI shall be strictly adhered to, with the following conditions: <br />a) City reserves the right to require revision to the tree species and tree <br />locations proposed along the Kelley Parkway frontage to ensure their <br />compatibility with the final Kelley Parkway streetscape plan yet to be <br />approved by the City Council. <br />b) The trash enclosure shall be further screened by vegetation to minimize <br />direct view of the opening by westbound Highway 12 traffic, subject to <br />City staff approval. <br />7. Lighting. Site lighting shall adhere to the approved lighting plan attached to this <br />agreement as Sheet LI. <br />8. Signage. Signage on the site shall bv limited to the required traffic control signage <br />and a monument style sign, which must receive a separate review and permit prior <br />to construction. Parking and traffic control signage shall be installed subject to <br />City staff and City Engineer approval. <br />B. Installation and Maintenance of Improvements <br />9.Improvements: In accordance with the policies and ordinances of the City of <br />Orono, the folloMdng described public or private improvements (herein^er <br />collectively called the “Improvements ”) shall be constructed, installed and <br />maintained by the Developer according to the terms and conditions contained in <br />this PUD Agreement: <br />(a) Site grading, driveways, curb and gutter, parking lots, sidewalks, retaining <br />walls if required and all necessary erosion control measures per the <br />Grading. Drairage, Erosion Control, and Utility Plan attached hereto as <br />Sheet Cl (hereinafter called "site grading improvements"); <br />(b) Construction of sanitary sewer and water connections (hereinafter called <br />“sewer and water improvements ”) and construction or relocation of storm <br />sewer lines and facilities (hereinafter called “stormwater improvements ”) <br />per the preliminary Utility Plan attached her-- • as Sheet Cl and C2. <br />! <br />Page 3 of 10
