Perry <br />Briggs & Morgan, P.A. <br />2200 IDS Center <br />80 South S’” Street <br />Minneapolis, MN 55402 <br />Re: Environmental Concerns <br />Proposed Subdivision of 3250 Fox Street (a/k/a Maxwell Bay Estates) <br />Dear Jack: <br />The purpose of this letter is to evaluate the environmental concerns associated <br />with the proposed subdivision of the property located at 3250 Fox Street (a/k/a <br />Maxwell Bay Estates) in 0:ono, Minnesota (Site). Specifically, ProSource <br />Technologies, Inc. (ProSource) has been asked to give its opinion as to whether the <br />proposed Maxwell Bay Estates subdivision poses the “potential for significant <br />environmental effects," to support a Citizens ’ Petition for preparation of an <br />Environmental Assessment Worksheet (EAW) in accordance with MinnesoU <br />Environmental Quality Board (MEQB) guidelines. <br />Based on PtoSource's review, several conditions were identified whereby the <br />proposed project poses the “potential for significant environmental effects," <br />including effects to wildlife and ecologically sensitive resources, cultural resources, <br />threatened and endangered species, and water quality. The following discussion <br />summarizes our findings. <br />A. DESCRIPTION OF THE PROJECT <br />The Site is 14.5 acres in size, and it is bounded by Lake Minnetonka (Maxwell <br />Bay) to the south and large-lot, single family dwellings (>4.5 acres) to the cast and <br />west, and a single family dwelling to the north. Based on our perimeter visual <br />survey of the Site and our review of aerial photographs of the Site, the Site was <br />previously developed with a single family dwelling within the south-central portion <br />of the Site. The northern half of the Site is undeveloped with numerous mature <br />hardwood trees and grasslands. The Lake Minnetonka shoreline was observed to be <br />mostly unimproved. <br />The proposed project consists of subdividing the Site into six lots of at least 2 <br />acres each. Three of the lots will be located along Lake Minnetonka with the other <br />three non-lakeshore lots located within the northern portion of the Site. Access to <br />the Site is proposed to be via a cul-de-sac constructed within the north central end of <br />the Site and intersecting with a private segment of Fox Street. Fox Street is located <br />along the northern end of the Site, and it provides access to the homeowners located <br />to the west. <br />Environmental • Right of Way • Engineering <br />J
