The applicant is no longer proposing any additions or any new <br />hardcover and all exterior walls will remain intact. From staffs perspective these plans <br />should no longer be reviewed as a rebuild and an interior remodel can be achieved simply by <br />applying for a building permit. Therefore, the original requests for the 75’-250 ’ zone have <br />been withdrawn. <br />However, the applicant is not wishing to withdraw her request completely but to revise it. <br />With the interior remodel, the applicant would like to replace the existing deck which has <br />rotted. A hardcover variance and average lakeshore setback variance are required to replace <br />the deck. The applicant has proposed a smaller deck of a new configuration. The proposed <br />configuration requires an average lakeshore setback variance. The existing deck encroaches <br />2 ’ into the average lakeshore setback and the applicant would tike to encroach 2 additional <br />feet in an effort to ..'thieve better views and for the deck to be more functional with the <br />interior floor plan of the house. <br />Revised hardcover calculations and the proposed deck footprint are attached to this memo. <br />The plans will result in a net decrease of 183 s.f. of hardcover, bringing hardcover in the 75’- <br />250 ’ zone to 39.25% when 40.45% currently exists. Consistently, approval is granted for <br />deck replacements when hardcover is not increased. The Planning Commission should <br />discuss whether any hardships exist to allow an additional 2 ’ encroachment on the average <br />lakeshore setback. Staff finds the topography of the lot restricts views and the deck footprint, <br />as proposed, will not affect either neighbor’s views to the lake. The neighbor to the north sits <br />at a much higher elevation and the neighbor to the south wouldn’t have views across the <br />applicants due to the changing topography. <br />Staff Recommendation <br />Approval of a hardcover variance to allow 39.25% hardcover in the 75’-250 ’ zone and an <br />average lakeshore setback variance to allow a 4 ’ encroachment in order to replace an existing <br />rotted deck. <br />Table the conditional use permit and hardcover variance request for the 0-75’ zone to allow <br />more detailed information to be submitted to the City Engineer. Two separate resolutions <br />can be drafted and approved separating the 0-75’ and 75’-250 ’ zones. <br />!
