3. Installation of any combination of fixtures requiring wastewater <br />plumbing that includes a toilet, shower or bathtub shall be allowed <br />only in an accessory building that is conforming in location, size and <br />height, which meets one of the following criteria; <br />a.The accessory building has been approved for a 'Guest House' <br />conditional use permit; or <br />b.The accessory building has been approved for a 'Plumbing in <br />Accessory Building' conditional use permit. <br />Source: Ordiiuncc No. 179,2nd Seria <br />Adopted: 10*12>98 <br />Accessory Buildings with Plumbing that includes a toilet, tub, or shower or a combination of these fixtures, <br />but not intended to be used as a Guest House, are governed by the “Plumbing In Accessory Building” CUP <br />standards of Section 10.03, Subd. 3(Q): <br />10.20, Subd. 3. Conditional Uses. Within any "R-1 A" One Family Residential <br />District, no structure or land shall be used for the following uses except by conditional <br />use permit: <br />Q. Plumbing in Accessory Building. The provision of a toilet, bathtub or <br />shower in an accessory building. Approval shall be conditioned on provision <br />of municipal sanitary sewer or a conforming sewage treatment system <br />designed to handle the anticipated flows from the building plumbing. <br />Approval shall be granted only when the following criteria are met: <br />1.The Council finds that the proposed use of the accessory <br />structure with plumbing will not be detrimental to the <br />residential character of the neighborhood. <br />2.The Council finds that the plumbing fixtures proposed are in <br />keeping with the intended use of the accessory building. <br />3. <br />4. <br />The property is 2.0 acres in area or larger. <br />The accessory building is conforming in location, size and <br />height. <br />5. <br />b. <br />The property owner agrees to the fi ling of a covenant in the title <br />of the property providing that: <br />a. the accessory building will not be used for a home <br />occupation unless specifically approved by City or if <br />allowed by City code. <br />the accessory building will not be used as a dwelling <br />unless a guest house CUP is obtained, <br />the accessory building will not be rented, leased or <br />otherwise provided for use as a dwelling under any <br />circumstances. <br />S«urct: Ordinaace No. 179,2od Serifs <br />Adopted: 10-12.91 <br />c. <br />9 <br />I • <br />I.
